Back in February I reported on the sad circumstances surrounding actor Dennis Hopper's health problems and impending divorce from his wife, Victoria: Estate Planning, Dennis Hopper Style.
As it turns out, Dennis and Victoria were still legally married at the time of his death on May 29, and so it has been speculated that Victoria will be seeking her share of Dennis' estate as provided for her in their prenuptial agreement which states that she will receive 25% of the estate and a $250,000 life insurance policy. The kicker is that according to TMZ.com the prenuptial agreement requires that Dennis and Victoria must have been "married and living together" on the date of Dennis' death. According to sources close to the couple, Victoria has been living in a separate house located on Dennis' property and not in the same house with him. So whether or not Victoria will receive her share of the estate as required by the prenuptial agreement will turn on the legal definition of "living together." This should be an interesting case for the probate judge to sort out.
